These Terms of Service (“Terms”) govern your access to and use of the website and services provided by Sun Sea Sky Inc (“we”, “us”, “our”), including requesting a renovation quote (the “Services”). By accessing or using the Services, you agree to these Terms.

2. Our Services

We provide one-stop renovation services, including consultation, quote preparation, design coordination, construction, cleaning, and final handover. The website may allow you to submit a Request for Quote (RFQ) and provide project information and optional reference images.

3. RFQ Submissions

  • Accuracy: You agree to provide accurate and complete information when submitting an RFQ.
  • Phone required: A phone number is required so we can follow up. Email is optional.
  • Uploads: If you upload images, you represent and warrant that you have all necessary rights to upload and share those images with us for quote evaluation purposes, and that doing so does not infringe any third-party rights.
  • No obligation: Submitting an RFQ does not obligate you to purchase services, and does not obligate us to accept or perform work.

4. Quotes, Estimates, and Contracts

Any quote, estimate, scope summary, or schedule provided through the Services is preliminary and may change based on site conditions, measurements, selections, and other factors discovered during consultation and project planning.

A binding agreement exists only when we and you sign a written contract (or other written acceptance) that describes the agreed scope, pricing, schedule, and terms.

5. Site Access and Conditions

If a site visit is required, you agree to provide reasonable access and disclose known conditions that may affect the work (e.g., building rules, structural constraints, moisture issues, hazardous materials). We may pause or decline work if conditions present safety or compliance concerns.

6. Acceptable Use

You agree not to:

  • Use the Services for unlawful, misleading, or fraudulent purposes.
  • Interfere with or disrupt the security or operation of the Services.
  • Attempt to gain unauthorized access to systems or data.
  • Copy, scrape, harvest, or reuse content from the Services except as expressly permitted in these Terms.

7. Intellectual Property and Copyright

All content on the Services, including text, graphics, branding, UI/UX, images, and other materials (collectively, “Content”), is owned by or licensed to Sun Sea Sky Inc and is protected by applicable intellectual property laws.

The 3D models, scenes, renders, and related assets made available through our /3d-room route and any related 3D experience (the “3D Assets”) are copyrighted and are the intellectual property of Sun Sea Sky Inc and/or its licensors. Unauthorized copying, downloading, reproduction, distribution, publication, reverse engineering, or creation of derivative works from the 3D Assets is strictly prohibited.

Infringement and misuse will be pursued to the fullest extent permitted by law, including civil remedies and other enforcement actions where appropriate.

8. User Content

“User Content” includes information and images you submit through the RFQ form. You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use it solely to evaluate your RFQ, communicate with you, and provide or prepare renovation services.

9. Disclaimers

The Services and Content are provided on an “as is” and “as available” basis. While we aim for accuracy, we do not guarantee that the Services will always be uninterrupted, error-free, or fully up to date. Renovation outcomes and timelines may vary based on conditions, selections, and other factors.

10. Limitation of Liability

To the maximum extent permitted by law, Sun Sea Sky Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Where liability cannot be excluded, it will be limited to the minimum extent permitted by law.

11. Indemnity

You agree to indemnify and hold harmless Sun Sea Sky Inc from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Services, your breach of these Terms, or your violation of any third-party rights (including by uploading content you do not have rights to use).

12. Privacy

Your use of the Services is also subject to our Privacy Policy and Cookie Policy.

13. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with an updated “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
